NPW are pleased to announce that we have updated our Good Practice Guide, and some other documentation including Pubwatch Rules and Code of Practice. This followed a comprehensive review carried out by barristers Rachel Kapila and Stephen Walsh QC from Three Raymond Buildings Chambers.
We instructed Rachel and Stephen to carry out the work due to their extensive experience of licensing issues and recent involvement in a High Court challenge, where an individual made an unsuccessful attempt to overturn a Business Crime Partnerships decision to exclude him from members premises. Whilst this challenge was not against a traditional Pubwatch, we were aware that the partnership contained licensee members and therefore the issues raised by the case could have had implications for the Pubwatch community.
We continue to believe that the previous challenges against Pubwatch schemes (e.g. Boyle v Haverhill Pubwatch 2009) have established the right of licensee members to collectively ban individuals from their premises and the value of the advice given in the Good Practice Guide.
